CLARAFIY TERMS OF SERVICE Last Updated: May 22, 2026 ACCEPTANCE OF TERMS By creating an account, accessing, or using Clarafiy ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. 1. DESCRIPTION OF SERVICE Clarafiy is an automotive transparency platform that provides: - Vehicle information lookup via VIN decoding - AI-powered diagnostic code explanations - Service record tracking - Shop finder and recommendation services - Community-driven shop verification - Gamification features (points, badges, leaderboards) 2. ELIGIBILITY You must be at least 18 years old to use this Service. By using Clarafiy, you represent and warrant that you meet this age requirement. 3. USER ACCOUNTS 3.1 Registration: You must provide accurate, current, and complete information during registration. 3.2 Account Security: You are responsible for maintaining the confidentiality of your password and account credentials. 3.3 Account Termination: We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity. 4. USER CONTENT 4.1 Your Responsibility: You are solely responsible for all content you submit, including vehicle information, service records, shop recommendations, and AI chat messages. 4.2 Accuracy: You warrant that all information you provide is accurate and truthful. 4.3 License Grant: By submitting content, you grant Clarafiy a worldwide, non-exclusive, royalty-free license to use, store, and display your content to operate the Service. 4.4 Prohibited Content: You may not submit content that is: - False, misleading, or fraudulent - Defamatory, obscene, or offensive - In violation of intellectual property rights - Contains personal information of others without consent 5. AI ASSISTANT DISCLAIMER 5.1 Educational Purpose: Raffy, our AI assistant, provides GENERAL AUTOMOTIVE INFORMATION ONLY for educational purposes. 5.2 Not Professional Advice: AI explanations are NOT: - Professional mechanical diagnoses - Safety recommendations - Substitute for qualified mechanic consultation 5.3 No Warranty: We make no representations about the accuracy, reliability, or completeness of AI responses. 5.4 Critical Disclaimer: If you have safety concerns about your vehicle, consult a certified mechanic immediately. Do not rely solely on AI-generated information. 6. DIAGNOSTIC CODE INFORMATION 6.1 General Information Only: Diagnostic code explanations are provided for educational purposes only. 6.2 Professional Consultation Required: Always consult a qualified automotive technician for: - Accurate diagnosis - Repair recommendations - Safety-critical concerns 6.3 No Liability: We are not responsible for any damage, injury, or loss resulting from your use or reliance on diagnostic code information. 7. VEHICLE HISTORY DATA 7.1 Data Sources: Vehicle information is sourced from: - NHTSA (National Highway Traffic Safety Administration) - User-submitted service records - Community recommendations 7.2 No Guarantee of Accuracy: We do not guarantee the accuracy, completeness, or timeliness of vehicle history data. 7.3 Market Value Estimates: Estimated market values are formula-based approximations and should not be relied upon for purchase, sale, or insurance decisions. 7.4 Recalls and Complaints: Recall and complaint data is sourced from NHTSA. We are not responsible for omissions or errors in this data. 8. SHOP FINDER AND RECOMMENDATIONS 8.1 Third-Party Information: Shop information is sourced from Google Places API and user recommendations. 8.2 No Endorsement: Listing a shop does not constitute an endorsement by Clarafiy. 8.3 Verification: "Verified" badges indicate community recommendations (3+ users) and do not guarantee quality or honesty. 8.4 User Responsibility: You are solely responsible for selecting service providers and verifying their qualifications. 9. PRICING AND COST ESTIMATES 9.1 Estimates Only: Repair cost estimates are regional averages and may not reflect actual costs in your area. 9.2 No Price Guarantee: Actual costs may vary significantly based on vehicle condition, parts availability, labor rates, and location. 9.3 Disclaimer: Price estimates are provided for informational purposes only and should not be used for budgeting or financial decisions without obtaining actual quotes. 10. GAMIFICATION 10.1 Points Have No Cash Value: Points, badges, and tier status have no monetary value and cannot be redeemed for cash or prizes. 10.2 Event Multipliers: Point multipliers during events (e.g., IPN Summit 2025) are subject to change without notice. 10.3 Fraud Prevention: We reserve the right to revoke points or badges obtained through fraudulent means. 11. PRIVACY AND DATA COLLECTION 11.1 Privacy Policy: Your use of Clarafiy is also governed by our Privacy Policy, incorporated by reference. 11.2 Location Data: When you enable location services, we collect your location only while using the Shop Finder feature. 11.3 Usage Analytics: We collect anonymized usage data to improve the Service. You may opt out in Settings. 12. INSURANCE INFORMATION SERVICE 12.1 Personal Organizer Only: Clarafiy provides a personal organizer for your own insurance information. We are NOT a licensed insurance broker, agent, or advisor. 12.2 No Insurance Advice: We do NOT provide coverage recommendations, advice, or guidance. 12.3 No Insurer Communication: We do NOT transmit your insurance data to insurers on your behalf. 12.4 No Claims Handling: We do NOT handle, submit, or assist with insurance claims. 12.5 OCR and Parsing Accuracy: OCR scanning and PDF parsing are best-effort services. You must verify all extracted data before relying on it. Clarafiy is not liable for inaccuracies in automatically extracted policy information. 12.6 Renewal Reminders: Renewal reminders are a convenience feature. Clarafiy does not guarantee delivery of reminder emails and you remain solely responsible for managing your own policy renewals. 12.7 Co-Branded Agent Content: When co-branded agent or partner content is displayed, it reflects business partnerships and does not constitute an endorsement or create any fiduciary responsibility on the part of Clarafiy. 12.8 Insurance Document License: By uploading insurance documents (including card images and PDF declarations pages), you grant Clarafiy a limited, non-exclusive, non-transferable, revocable license to store, process, and display them solely for the purpose of providing the insurance organization features of the Service. This license terminates when you delete the documents or your account. 13. INTELLECTUAL PROPERTY 13.1 Ownership: Clarafiy and all associated trademarks, logos, and content are owned by Clarafiy or our licensors. 13.2 Limited License: We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. 13.3 Restrictions: You may not: - Copy, modify, or distribute our content - Reverse engineer the application - Use automated tools to scrape data - Create derivative works 14. THIRD-PARTY SERVICES 14.1 External Links: The Service may contain links to third-party websites or services not controlled by Clarafiy. 14.2 No Responsibility: We are not responsible for the content, privacy policies, or practices of third-party services. 14.3 API Dependencies: The Service relies on third-party APIs (NHTSA, Google, DeepSeek). Service interruptions may occur. 15. LIMITATION OF LIABILITY 16.1 NO LIABILITY FOR DAMAGES: TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLARAFIY SHALL NOT BE LIABLE FOR: - INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES - LOSS OF PROFITS, DATA, OR GOODWILL - VEHICLE DAMAGE OR INJURY - DAMAGES RESULTING FROM YOUR USE OF THE SERVICE 16.2 MAXIMUM LIABILITY: Our total liability to you shall not exceed the amount you paid to Clarafiy in the twelve (12) months prior to the claim (currently $0 for free users). 17. INDEMNIFICATION You agree to indemnify and hold harmless Clarafiy, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorney's fees) arising from: - Your use of the Service - Your violation of these Terms - Your violation of any third-party rights - Content you submit to the Service 18. CHANGES TO TERMS 18.1 Right to Modify: We reserve the right to modify these Terms at any time. 18.2 Notice: We will notify you of material changes via email or in-app notification. 18.3 Continued Use: Your continued use after changes constitutes acceptance of the modified Terms. 19. TERMINATION 19.1 Your Right: You may terminate your account at any time through Settings. 19.2 Our Right: We may suspend or terminate your access immediately if you violate these Terms. 19.3 Effect of Termination: Upon termination, your right to use the Service ceases, and we may delete your data. 20. DISPUTE RESOLUTION 20.1 Informal Resolution: Before filing a claim, you agree to contact us at legal@clarafiy.com to attempt informal resolution. 20.2 Arbitration: Any disputes shall be resolved through binding arbitration rather than in court, except where prohibited by law. 20.3 Class Action Waiver: You waive any right to participate in class action lawsuits. 21. GENERAL PROVISIONS 21.1 Governing Law: These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. 21.2 Severability: If any provision is found unenforceable, the remaining provisions continue in effect. 21.3 Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Clarafiy. 21.4 No Waiver: Our failure to enforce any provision does not constitute a waiver of that provision. 21.5 Assignment: You may not assign these Terms.
